1. Introduction
Welcome to Black Bottom ("we", "us", "our"). This User Agreement governs your use of the Black Bottom mobile application ("App"). By accessing or using the App, you agree to this Agreement. If you do not agree, you must stop using the App.
2. Eligibility
You must be at least 13 years old to use the App. To create a business listing, you must be at least 18 and authorized to act for that business. By using the App, you represent that you meet these requirements.
3. User Accounts
To access certain features, you may need to create an account. You agree to provide accurate and complete information, keep your login credentials secure, and notify us of unauthorized access. We may suspend or terminate accounts that violate this Agreement.
4. User Types
Customers use the App to search for and interact with businesses. Business owners create and manage listings and are responsible for ensuring their listings are accurate, lawful, and up to date.
5. Information We Collect
We collect information you provide directly, such as name, email, business details, favorites, reviews and other content you post, and profile information, and the messages you send in the App. We also collect device data, usage analytics, crash logs, and location data (with permission). Our Privacy Policy, at www.blkbtm.com/privacy-policy, explains this in full and is part of this Agreement.
6. How We Use Your Information
We use your information to provide and improve the App, display relevant business listings, personalize your experience, communicate with you, verify business ownership, and maintain platform safety. When you contact a business directly through the App, we share your name and email address with that business so they can respond to you. We do not sell your personal information.
7. Business Listings
By submitting content such as names, descriptions, images, locations, and contact details, you grant us a non-exclusive, worldwide, royalty-free license to display and distribute it within the App. We may remove content that is false, harmful, or in violation of this Agreement.
8. Reviews and Other User Content
Customers may post reviews, ratings, and other content about businesses. Reviews reflect the opinions of the individual poster, not Black Bottom, and are not verified for accuracy. By submitting a review or other content, you grant us the same license described in Business Listings above, and you agree not to post false, defamatory, or misleading statements. You may report content you believe violates this Agreement, and we may remove any content that does.
9. Contacting Businesses
When you message a business in the App, your name and email address are shared with the business owner so they know who they are talking to and can reply. Messages are stored so both of you can see the conversation. Business owners can block people who message them. We are not responsible for how a business uses or handles information you choose to share with them.
10. Location Services
With your permission, the App may access your device's location to show nearby businesses, enable distance-based filters, and improve search relevance. You may disable location access at any time, though some features may not function.
11. Prohibited Conduct
Black Bottom has zero tolerance for objectionable content and abusive users. You agree not to post or send content that is harassing, hateful, threatening, sexually explicit, violent, or spam, and not to use the App for unlawful purposes, impersonate another person or business, upload harmful or fraudulent content, attempt to disrupt or reverse-engineer the App, or scrape data from the App. You can report content in the App, and business owners can block people who message them. We review reports promptly and remove content that violates this Agreement; violations may result in account termination.
12. Intellectual Property
All content within the App (excluding user-submitted content) is owned by Black Bottom or its licensors. You may not copy, modify, or distribute any part of the App without permission.
13. Third-Party Links
Business profiles may contain links to third-party websites or services. We are not responsible for their content, availability, security, or practices. You access them at your own risk.
14. Disclaimers
The App is provided "as is" without warranties of any kind. We do not guarantee accuracy of business information, availability of the App, or that businesses will respond or provide services. You use the App at your own risk.
15. Limitation of Liability
To the fullest extent permitted by law, Black Bottom is not liable for losses resulting from use of the App, business interactions or transactions, or errors, outages, or data loss. Our total liability will not exceed the amount you paid for using the App (typically $0).
16. Termination
We may suspend or terminate your account at any time for violations of this Agreement, fraudulent or harmful behavior, or legal or security concerns. You may delete your account at any time.
17. Paid Plans for Businesses
Business owners may be offered optional paid plans. Payment is charged to your Apple App Store or Google Play account when you confirm the purchase. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period, and you can manage or cancel them in your App Store or Google Play account settings. Refunds are handled by Apple or Google under their policies. Deleting your Black Bottom account does not cancel a subscription.
18. Changes to This Agreement
We may update this Agreement periodically. Continued use of the App after changes are posted means you accept the updated terms.
19. Governing Law
This Agreement is governed by the laws of the State of Michigan. Any disputes will be resolved in courts located in Detroit, MI.
